Mental Health and the Law: Burden(s) Of Proof
In most jurisdictions, the not guilty by reason of insanity’ defense must be established by a particular burden of proof when raised in court by an eligible criminal defendant. What is that legal burden? How does this burden compare to the prosecution’s legal burden of proof beyond a reasonable doubt when attempting to establishing a defendant’s criminal liability? To whom must these legal burdens be proven and why?
