a) Critically analyse the evolution of the test for breach of duty in consent cases since the case of Sidaway v Board of Governors of the Bethlem Royal Hospital and the Maudsley Hospital [1985] AC 871 including analysis of the extent to which the Supreme Court decision in the case of Montgomery v Lanarkshire Health Board [2015] UKSC 11 has transformed the test for breach of duty. b) Critically analyse the extent to which a child’s consent to or refusal of medical treatment may be legally valid. (50%)
