Using complete sentences, in a short paragraph answer the following questions (5 points each):

1) A negligence claim is a claim for an unintentional tort. List the four required elements of a negligence claim. If one element is missing, can you still have a potentially successful negligence claim?

2) There is a rule that harm must be foreseeable in order to constitute the proximate cause of an injury under a negligence theory. This is an important rule for a manager to know. Give a couple of examples of how a manager might approach this challenge. (Think outside of the box on this one!)

3) The length of time for protecting copyrighted material is lengthy. Briefly describe that protection period and why a teacher might be able to make copies for a classroom without paying for royalties.

4) A maintenance manager at a bank who has cleaning responsibilities after hours found a teller’s drawer unlocked. He dishonestly takes money out of the drawer. Is this embezzlement or larceny? Why?
