  • Pick one case from the assigned list posted on Blackboard
    • Must must start with an overview of the facts (10 points)
    • Then you must follow with the IRAC format
      • Issue (20 points)
      • Rule (Rule of law) (25 points)
      • Analysis (How did the court weave the facts into the rule of law. This is where your follow the courts reasoning and apply the courts reasoning to the rule of law) (30 points)
      • Conclusion (10 points)
      • Opinion (30 points)
    • For most of the brief I am interested in your review of what the court did and how they tied the facts of the case into the rule of law; i.e. I am interested to see if you can follow the courts reasoning and tie the reasoning into the facts for a proper Analysis.
    • On the last part of the Brief, I want your opinion as to whether you believe the court was correct in its ruling and why. I will be looking for sound reasoning for your opinion (using facts and law). This is worth 30 points, so don’t forget it.
    • Make sure you separate each section so that I can figure out whether you are writing about the Issue or the Rule of Law. Do not run your paper into narrative so I need to figure out where the different parts of your brief are.
    • All papers must be typed
    • Font must be 12 -13 pt.
    • Double Space
    • Must be 3-4 pages
    • Review handout on-line or Appendix A in the back of the book relating to briefing of cases to give you more ideas as to how someone briefs a case. However you must follow the Facts, Issue, Rule, Analysis, and Conclusion format.
    • Important Grading Points
      • Is the appearance of the paper professional i.e. no spelling errors (no hair pins, paper clips, folded papers, or folded over edges)?
      • Is your sentence structure correct? Do your thoughts make sense?
      • Did you follow the IRAC format?
      • Did you spot the right issue?
      • Did you quote the correct law?
      • Does your analysis flow smoothly and does it follow the courts reasoning?
      • Are you filling the paper with lines of thoughtful concepts or random nonsense?
      • Did you state your opinion on the case and back it up with some sound reasoning?
